TERMS OF USE

These terms are the rules for using the SANDIT mobile app, the SANDIT Sensor and the rider community inside the app (together, the “Services”). We have tried to keep them short and readable. Where something really matters, we say so plainly.
1. WHO WE ARE

In these terms, “SANDIT”, “we” and “us” mean Arjodima Holding B.V. “You” means the person using the Services.
2. ACCEPTING THESE TERMS
By creating an account or using the Services, you agree to these terms. Please also read our Privacy Policy, which explains what we do with your personal data. If you do not agree with these terms, do not create an account and do not use the Services.
Some things have their own extra terms, such as a founder reservation or a paid membership. Those are shown to you before you agree to them, and on that subject they take priority over these terms.
3. WHO CAN USE SANDIT
- You must be 16 or older to create a SANDIT account on your own.
- Under 16? You may only use SANDIT with the permission of a parent or guardian. They agree to these terms on your behalf and are responsible for how you use the Services.
- School riders. If you ride with a surf, kite, wing or windsurf school, you can join with the school’s code and your first name. Your sessions then appear on that school’s board, which the school and its riders can see. These terms apply to you too, and the school is responsible for having the permission it needs from its students (and, for minors, from their parents or guardians).
4. YOUR ACCOUNT
- Be accurate. Give correct information when you sign up and keep it up to date.
- One person per account. Do not share your account, and do not create an account for someone else without their permission.
- Keep it safe. Keep your password, and the Apple or Google account you sign in with, secure. You are responsible for what happens under your account.
- Tell us about misuse. If you think someone else is using your account, email crew@sandit.club straight away.
- Pick a fair name. Your display name and photo must not impersonate someone else or break the community rules in section 7.
5. THE SENSOR, THE APP AND THE NUMBERS
SANDIT turns GPS and motion data from the sensor (or your phone) into numbers: speed, distance, routes, jumps, tricks, turns and more. We work hard to make them right, but every number is an estimate. GPS can drift or drop out, and jumps, heights, rotations and speeds are detected by algorithms that can miss things, count things that did not happen, or get the size wrong. Results can also change after a session has been analysed again.
SANDIT is not a safety device. It is not a rescue, emergency, tracking-for-safety or navigation device. It does not call for help, does not alert anyone if something goes wrong, and must not be used to find your way or to judge whether conditions are safe. It is not a dive computer.
Watersports are dangerous. Surfing, kitesurfing, windsurfing, wingfoiling and the other sports SANDIT tracks carry a real risk of serious injury or death. You take part at your own risk. Ride within your ability, check the conditions and local rules, use proper safety gear, and never take extra risks to chase a number, a leaderboard spot or a challenge.

6. YOUR CONTENT
“Your content” is everything you add to SANDIT: sessions, routes, metrics, photos, videos, titles, captions, comments, messages and your profile.
- You own it. We do not claim ownership of your content.
- You give us permission to use it to run SANDIT. You grant us a worldwide, non-exclusive, royalty-free licence to store, copy, process, display and share your content, only as needed to provide, protect and improve the Services (for example to improve how we detect jumps and tricks), and always in line with the visibility you chose. This licence ends when you delete the content or your account, apart from backup copies that expire as described in our Privacy Policy and anything we must keep by law or to handle a report.
- Public means public. A public session, with its route, metrics, photos and your profile name, can be seen by every signed-in SANDIT user: in the community feed, on your profile, on leaderboards, in challenges, and in crews or schools you belong to. A private session is visible only to you. You can change a session’s visibility at any time, but we cannot undo what others already saw, for example in a screenshot.
- You are responsible for what you post. Only post content you have the right to share. If other people are recognisable in your photos or videos, or you tag them, make sure they are fine with it.
- You can delete it. You can delete your sessions, photos, videos and comments, or your whole account, at any time.
7. COMMUNITY RULES
SANDIT is a community of riders. We have zero tolerance for objectionable content and abusive users. You must not post, send or share anything that is:
- Harassment or bullying, including threats, intimidation or encouraging others to target someone.
- Hateful, attacking people for their race, ethnicity, nationality, religion, gender, sexual orientation, disability, age or any similar characteristic.
- Sexual, including nudity and sexually suggestive content. Anything that sexualises a minor is removed immediately and reported to the authorities.
- Violent or threatening, including graphic violence and content that encourages self-harm.
- Illegal, or promoting illegal activity.
- Impersonation: pretending to be another person, rider, school or brand.
- Spam or scams: unsolicited advertising, chain messages, fake accounts, or links meant to mislead.
- Someone else’s private information, such as their home address, contact details or where they can be found, without their permission.
- Fake sessions or records: uploading someone else’s data as your own, editing or manipulating session files, or recording from a car, boat or anything else to fake a speed, jump or result.
- Infringing, such as photos, videos or music you do not have the rights to.
7.1 Reporting and blocking
- Report: in the app, use Report on a session or a rider’s profile and tell us what is wrong.
- Block: use Block rider on a session or profile to stop that rider from interacting with you. You can unblock them later.
- Email: for anything else, such as a comment or a message, email crew@sandit.club with a description and, if you can, a screenshot.
7.2 What we do with reports
We review every report within 24 hours. If content breaks these rules, we remove it, and we suspend or permanently ban the account that posted it. We may also act without a report when we become aware of a problem, and we cooperate with the police and other authorities where the law requires it. When we restrict your content or account, we tell you why, unless the law or someone’s safety prevents us. If you think we got it wrong, email crew@sandit.club and we will look at it again.
8. LEADERBOARDS, CHALLENGES AND CREWS
Leaderboards, challenges and crew rankings are there to make riding more fun, and they are only fair if everyone rides for real. Their results come from the same estimated numbers described in section 5. We may correct, exclude or remove any result that looks faked, manipulated or caused by a measurement error (for example a GPS glitch), and we may remove an account from a leaderboard or challenge if it breaks these rules. Unless a challenge clearly says otherwise, there are no prizes. If a challenge does have prizes, its own rules apply.
9. ACCEPTABLE USE
Use the Services the way they are meant to be used. You must not:
- Copy, modify, reverse engineer, decompile or try to extract the source code of the app or the sensor’s firmware, except where the law expressly allows it.
- Scrape, crawl or harvest data from the Services, or access them with bots or other automated tools.
- Interfere with or overload the Services, or upload viruses or other harmful code.
- Probe, scan or bypass our security, or access accounts or data that are not yours.
- Use the Services for commercial purposes, such as advertising or reselling access, without our written permission.
- Help or encourage anyone else to do any of the above.
10. THIRD-PARTY SERVICES
Parts of SANDIT rely on other companies’ services, for example Sign in with Apple and Google sign-in, maps (Mapbox), historical weather data, video hosting (Mux), sharing to Instagram and other apps, and the App Store and Google Play. When you use them, their own terms and privacy policies apply as well. We are not responsible for those services, and if one of them is unavailable, the SANDIT features that depend on it may not work.
11. PURCHASES, MEMBERSHIP AND WARRANTY
These terms cover using the app, the sensor and the community. Buying or reserving a sensor and a Founders Club membership is covered by the terms shown at checkout and our founder pre-order policy. For faults and returns, see warranty and repairs and returns and your right to withdraw. Your statutory consumer rights, including the legal guarantee and the 14-day right of withdrawal, always apply in full.
12. AVAILABILITY AND CHANGES TO THE SERVICES
We work to keep SANDIT running smoothly, but we cannot promise that it will always be available or free of errors. We may need to pause it for maintenance, and we keep improving it, which means we may add, change or remove features. If a change takes away something important that you pay for, we will tell you in advance and your consumer rights stay intact. If we ever stop offering the Services, we will give you reasonable notice and tell you how to get a copy of your data.
13. ENDING YOUR ACCOUNT
You can leave at any time. Delete your account in the app, or at sandit.club/delete-account. This erases your profile, sessions and activity and cannot be undone. See deleting your account for what happens to your data and how to get a copy first.
We can suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if it is needed to protect other riders or the Services. We tell you why, unless the law or someone’s safety prevents us, and you can ask us to reconsider by emailing crew@sandit.club.
14. OUR LIABILITY
We provide the Services with care, but because of what sections 5 and 12 explain, we cannot promise that every number is correct or that the Services always work.
As far as the law allows, we are not liable for:
- Injury, loss or damage that results from the risks of watersports themselves, or from relying on the numbers, maps or other information the Services show.
- Loss that was not foreseeable when you started using the Services, or indirect loss.
- Problems caused by things outside our reasonable control, such as a failure of a third-party service or of your phone’s network.
None of this limits our liability for death or personal injury caused by our negligence, for fraud, for damage caused intentionally or through gross negligence, or for anything else that cannot be limited by law. And nothing in these terms takes away the mandatory rights you have as a consumer.
15. PRIVACY
We handle your personal data, including your location and session data, as described in our Privacy Policy (Nederlands).
16. CHANGES TO THESE TERMS
We may update these terms as the Services change or the law requires. The date at the top always shows the current version. If a change materially affects you, we will tell you in the app or by email before it takes effect. If you do not agree with the new terms, you can stop using the Services and delete your account. If you keep using them after the change takes effect, the new terms apply.
17. GOVERNING LAW AND DISPUTES
These terms are governed by Dutch law. If you are a consumer living in another country, you keep the protection of the mandatory consumer law of that country. If something goes wrong, please contact us first, and we will try to sort it out together. If we cannot, disputes go to the competent court in the Netherlands, although as a consumer you may also bring a claim before the courts where you live.
If any part of these terms turns out to be invalid, the rest still applies. If we do not enforce a rule straight away, we can still enforce it later.
